Code of Conduct & Corruption

In meeting the commitment to the community of full accountability and transparency, Section 439 of the Local Government Act requires that every Councillor, member of staff of a Council and delegate of a Council must act honestly and exercise a reasonable degree of care and diligence in carrying out his or her functions under this or any other Act.

The Code of Conduct, and the Code of Conduct - Summary for Staff provides a practical means of identifying and resolving situations which involve conflict of interest or improper use of their positions and to act in a way which enhances public confidence in the system of local government.

Section 440 of the Local Government Act 1993 requires that every Council prepare or adopt a Code of Conduct to be observed by Councillors, members of staff of the Council and delegates of the Council.

The Council must, within 12 months after each ordinary election, review its Code of Conduct and make such changes to it as it considers appropriate.

The Code covers such issues as:

  • Bribes, Gifts, Benefits, Travel & Hospitality
  • Use of Information
  • Use of Council Resources and Equipment
  • Equitable Treatment
  • Outside Employment or Business by Staff
  • Public Comment
  • Post Separation Employment
  • Discrimination and Harassment
  • Sexual Harassment
  • Alcohol and Other Drugs
  • Corruption, Maladministration, Serious and Substantial Waste

Corruption

The community expects public officials to perform their duties honestly and in the public's best interest. 

Corrupt conduct could involve:

  • the dishonest or partial exercise of official functions
  • a breach of public trust
  • the misuse of information on material acquired in the course of official functions
The Independent Commission Against Corruption (ICAC) exposes, prevents and educates about corruption.
