Independent Facilitators Draft LEP Public Hearing Reports

Council held public hearings during November 2011 regarding proposed changes under the Draft Holroyd Local Environmental Plan (LEP) 2011 to the zoning and development controls for Merrylands Town Centre, Wentworthville Town Centre and the Veron and Lytton Street area.

The hearings were conducted by an independent facilitator in accordance with the provisions under the former Section 68 of the Environmental Planning and Assessment Act 1979.

The independent facilitator has completed their report of the public hearings and in accordance with the former Section 68 (2) of the Act, the report has been provided to Council and is being made available to the public.

The independent report provides a summary of the proceedings and the points made by each person in their verbal submission to the hearing. Views expressed in the report are not those of the facilitator, but rather those expressed by members of the public. The Wentworthville report will be considered with the Council report on the comprehensive LEP early in 2012, in relation to the Veron and Lytton Street area. Both reports will then be considered with a further report on the Merrylands and Wentworthville centres later in the year, following further public exhibition of the controls for these centres.

DISCLOSURE OF INFORMATION

The names and addresses of speakers were collected prior to or during the hearings for the purposes of identifying each persons comments and generally identifying their location for contextual purposes. This was explained by the facilitator at each of the sessions. It is understood by Council that the facilitator advised that a report would be prepared containing each person's name and address and summarising each person’s submission. It is also understood that the facilitator advised that the report would be a public document.

The reports provide only the details the facilitator considered necessary, being the person's name and suburb. The person's street address has also been included where offered by the individual in their submissions. Details are being used for purposes for which they were collected. Release of the report with this information is in accordance with the Section 18(1)(a) of the Privacy and Personal Information Protection Act 1998. One persons details have been withheld upon request on appropriate grounds and Council has no reason to believe that any other individual concerned objects to the disclosure.
